William ‘Wim’ Boissevain is now 85 but he remains one of Western Australia’s greatest living art treasures and shows no sign of slowing.

His new solo exhibition ‘New Beginnings’ launches this week in Subiaco, and will feature Spinifex Hill (right) and Pilbara Landscape (below).

Boissevain has been one of the nation’s best-loved painters for six decades.

He received the Order of the British Empire back in 1978, has works in almost every state gallery in Australia, and is collected in the private galleries of Europe.

It is not uncommon for some of his popular works to fetch $30,000 or more.

The son of a Dutch diplomat, Boissevain spent his youth travelling before studying art at the l’Academie des Beaux Arts in Paris and the Central School of Art and Crafts in London.

A lifetime appreciation of French artist Edgar Degas sculpted Boissevain’s style to show a dreamlike appreciation of beauty that glides between realism and impressionism.

Linton Partington co-owns Linton & Kay Gallery and has known Boissevain since 1999.

Partington says the landscapes in ‘New Beginnings’ are sourced from Boissevain’s memory.

“He is not a painter who paints en plein air,” Partington says.

“He used to.

“These days he paints from the memories he’s collected.”

Partington says that Boissevain’s powers of observation may not be a realistic portrayal but that he captures the essence of the places he paints.

“It might be a memory of the Darling Range from 20 years ago,” Partington says.

“He might have been wandering through the bush and this sight has stuck with him.”

Boissevain tells oneperth.com.au that many of his new oil landscapes use older watercolours as a reference.

“I will do oils of those pictures, with imaginative qualities of course,” he says.

“Most of the oils that are in this exhibition are reasonably imaginative.

“They are not photographic or direct copies of scenes.”

Boissevain says that some people believe his lush landscapes are depicted to show beauty, but that his aim is to capture the subtle colour of Western Australia.

“When I first arrived here, everything appeared very grey,” he says.

“The Australian bush, if you walk out there, without too much sun, you think it’s all grey.

“As the light comes, you can appreciate a change in the colours

“They are beautiful, but some artists will exaggerate the colour.”

Boissevain is humble about the praise his work has received.

“I was reasonably successful, due to a bit of luck,” he says.

“The thing is, when people decide they do have a high regard for your work, they wait for your next works to appear.

“There is always anticipation.”

‘New Beginnings’ will display at Linton & Kay gallery – on the corner of Railway and Nicholson roads, Subiaco – from this Thursday to March 4.

Mosman Park fire tamed

Mosman Park fire tamed

5.15PM: A suspiciously-lit fire that shut down a kilometre of Stirling Highway at Mosman Park during the afternoon traffic peak is now under control and the highway reopened.

With the peak in full swing, firefighters had closed Stirling Highway in both directions between Vlamingh Parade and Victoria Street.

The Fire and Emergency Services Authority has now given the ‘all-clear’ as the blaze – near the corner of the highway and Boundary Road – is now under control.

Choppers fill up at Gil Fraser Reserve, North Fremantle.

Firefighters are mopping up and FESA is urging locals to remain alert.

Motorists have been asked to drive carefully due to smoke and emergency services personnel in the area.

Twenty firefighters and two helicopters attended the blaze that was reported at 3.06pm today.

FESA estimates 10 hectares were burnt out and that the cause of the fire was suspicious.

Anyone who saw dodgy activity around the scene of the blaze should call Crime Stoppers on 1800 333 000.

Cyclists crash head on

Cyclists crash head on

STAFF REPORTER

Major Crash police are seeking help in their investigation of a head-on bicycle crash that seriously injured two cyclists on Sunday, January 29.

About 9.15am, a group of five cyclists was travelling south along the bicycle path behind the Claremont Showgrounds Train Station.

A 50-year-old man leading the group collided with another man who was cycling in the opposite direction.

Police spokeswoman Naomi Smith said that both cyclists were seriously injured during the crash.

Acting Sergeant Smith said her Major Crash colleagues would like to hear from anyone who saw the collision.

Anyone with information should call Crime Stoppers on 1800 333 000.

Missing Sir Charles Gairdner patient found

STAFF REPORTER

DECEMBER 27 UPDATE: A 30-year-old man who walked out of the emergency department of Sir Charles Gairdner Hospital on Christmas Eve was found safe and well today.

Police and the hospital had feared for the safety of Samuel George Yates (pictured) after he left the hospital on Christmas Eve.

Police spokeswoman Naomi Smith said Mr Yates was found “safe and well” today in the Perth CBD.

Acting Sergeant Smith said Mr Yates was now in the care of staff at the hospital.

Plans to liquidate a $2.7 million yacht bought for Radhika Oswal just before receivers assumed control of Burrup Fertilisers from her billionaire husband Pankaj have been thrown out of the Federal Court.

PPB Advisory was appointed receiver to Perth-based Burrup on December 17 last year.

Seven weeks before that, Mr Oswal authorised Burrup’s purchase of a luxury yacht for $2.71 million, a written Federal Court ruling handed down yesterday by Justice Neil McKerracher reveals.

The same month the receiver took control of Burrup, the Oswals departed Perth for their native India. They now live in Dubai.

Before Justice McKerracher, PPB claimed an interest in the yacht. The company asserted the vessel was rapidly deteriorating due to lack of maintenance.

However, a firm owned and directed by Mrs Oswal claimed to own the yacht, and furnished photographs that showed no significant deterioration.

PPB contended Burrup funds were used improperly to buy the vessel and that Mrs Oswal’s company paid nothing for it.

The receiver argued the moored yacht could decay and its value be slashed ahead of any win PPB might have in its legal battle to reclaim more than $200 million from the Oswals.

On discovering the yacht was uninsured, PPB insured it for the period September 23, 2011 to December 23, 2011 (today).

PPB is also paying $22,000 a year for pen fees.

The yacht’s manufacturer has told PPB that a service costing $10,000 must be done immediately and repeated four times a year.

Justice McKerracher found the quality of evidence in relation to the yacht’s deterioration to be “a little sketchy”.

“I think it is appropriate that orders be made permitting the receivers to have access to the yacht to carry out maintenance work at their own expense pending the outcome of the claim,” he concluded.

“Obviously, if the claim ultimately succeeds, the expenses should be reimbursed.”

Justice McKerracher dismissed PPB’s application and ordered the company to pay legal costs.

Police seek agitated knife carrier

Police are searching Mosman Park for a 22-year-old man believed to be in an agitated state and carrying two knives.

Sergeant Gerry Cassidy says the man is in an agitated state and believed to be in possession of two knifes.

The man is Aboriginal, 170cm tall, of stocky build and has hazel eyes and short, black hair.

He is wearing grey, ¾-length shorts, a light blue T-shirt and pink-soled shoes.

He was last seen in the area of Tom Perrot Reserve off McCabe and Fairbairn Streets.

Sergeant Cassidy said the man should not be approached but anyone seeing him should call police on 131 444.

A man who knocked out a smaller rival who was dancing with his ex-girlfriend will remain barred from pubs and clubs despite objections he will miss out on Christmas socialising.

On July 14, George Mark Lewer punched a man at The Red Sea nightclub in Subiaco, causing him to fall backwards and black out.

The victim was dancing with Lewer’s ex girlfriend.

A decision handed down last week by Liquor Commission member Greg Joyce noted the victim was smaller than Lewer, received stitches to his mouth and has since suffered headaches.

On October 10, Lewer pleaded guilty to a charge of assault causing bodily harm. He received a spent conviction and was slapped with a $2000 fine, $1500 of which was payable to the victim.

On September 11, Lewer had been banned from entering pubs and clubs until February 29 next year.

In his appeal of that barring notice before Mr Joyce, Lewer claimed the ban was particularly onerous during the Christmas period.

However, police respondent Leanne Atkins argued an assertion by Lewer that he was provoked when the victim smirked at him did not make the attack any less serious.

Ms Atkins also asserted that Lewer’s rights to socialise at Christmas did not outweigh the need to protect the public from violent and disorderly conduct.

Mr Joyce determined there was nothing to suggest Lewer was over the relationship with his ex.

He found there was some risk Lewer could reoffend if confronted with a similar situation.

Consequently, the appeal was dismissed.

The government’s three-year-long local council ‘reform’ process has hit a brick wall in Perth where the City of Subiaco has blocked a Local Government Advisory Board push for an inquiry into a mooted merger with the City of Nedlands.

In the Supreme Court today, Justice James Edelman ruled that a writ of prohibition be made final against the board’s planned inquiry because a City of Nedlands proposal did not comply with the Local Government Act.

The inquiry was to have been an important step toward amalgamation of the two tiny councils.

After today’s judgement, Subiaco Mayor Heather Henderson said she was heartened that “common sense” had prevailed.

“This is a victory for the Subiaco community,” Ms Henderson said.

“With both local governments and their communities opposing a merger, there was no reason for the inquiry to go ahead.

“It would just be a waste of resources.”

Ms Henderson said the inquiry would only have created “division and angst” in Subiaco and Nedlands.

Mr Castrilli launched his ‘reform’ process in February 2009, but pressure from councils soon forced him to withdraw his threat to force amalgamations between municipalities that refused to play ball.

In June, the government tried reviving its moribund process by forming a committee headed by an academic to draw up new boundaries so the number of metropolitan councils could be slashed.

The committee’s recommendations on new council boundaries are due by June 2012 – 40 months after Mr Castrilli first announced his reforms.

Perth has 29 city, town and shire councils. This is 29 times the number of local authorities in each of metropolitan Brisbane, Canberra and Darwin which each have just one city council.

A rapid-fire email exchange between the publisher of a glossy housing magazine, and a saleswoman he was soon to unfairly sack, gives insight into the staffing practices of a struggling business.

In a decision published last week, WA Industrial Relations commissioner Jennifer Harrison ordered the family trust of Scott Turner – trading as VIP Publishers and AdConnect Local Marketing – pay Emma Criniti $8528.18 compensation for commissions she had earned but which he had refused to pay.

Mr Turner was the proprietor of Floreat-based WA Custom Homes, an annual glossy that pitches advertising space mainly to builders and materials suppliers.

Ms Criniti had sold advertisements for the magazine between February 23, 2009 and December 21, 2010 when she was fired.

Her clients included luxury home builder Zorzi, furniture retailer Artique, Lighting City, Ceramic City, Austral Bricks, Brikmakers, and the Bra Bar.

The WA Custom Homes website also runs ads for organisations including Riverstone Homes, Midland Brick, Bristile Roofing and Gomboc Gallery.

An email exchange published in Ms Harrison’s decision shows Ms Criniti feared she would “be living on two minute noodles” when Mr Turner first told her she would not be paid.

He in turn claimed he was “broke” thanks to poor sales. He contended his house was on the line and he could not buy Christmas presents for his three children.

“Im not not paying, I got no frickin money to pay,” he emailed Ms Criniti.

He claimed he owed $30,000 in tax and that the Australian Taxation Office was suing him.

Also on Mr Turner’s creditors’ list were his writers ($20,000), printers ($20,000) and various shops ($25,000).

Mr Turner further claimed he was having industrial problems with a graphic designer.

He decried some of his writers as “prima donna” contributors who wanted “thousands” of dollars for “crap writing”.

“I’m tired of being abused every week by a different asshole somewhere too, I have flogged myself and have had enough,” he emailed.

Ms Criniti said the situation would also mean a lean Christmas for her.

“I also have a mortgage and car payments to make and also can’t buy anyone any friggin xmas presents now,” she wrote.

“How dare you lead me on and not have the guts to end my employment and pay up what you owe and just keep using me.”

After considering the lengthy email exchange that follows, Ms Harrison found Ms Criniti had been unfairly dismissed:

Fourthly – I had an appt with M & B Sales on Thursday and they want to be a supplier on the builder directory I quoted them $750 plus gst for the year with only a landing page and she emailed me back to say they want to go ahead, so shall I sign up and when would they be up and running, in January?

Fifthly – Some clarification is needed before I continue working as I can’t make out from what you have been emailing me if I still am employed and still being paid base wage only and you will pay me the commissions due when you have some more money or if you are totally broke and expecting me to work for free until you have some money to pay back what I am owed. You haven’t given me any clue apart from alarming me that it sounds like I will be living on 2 minute noodles for xmas and probably all of January, should I be looking for another job, I hope not?

Anyway I hope to hear from you shortly so we get everything sorted out and can make a plan for the future and hopefully get things back on track to get money back in for both of us, cheers.

I asked you the other week about money and you said all is fine you have lots coming at the end of the year. You are the one who said clients don’t have to pay until the directory and Perth VIP are launched, why did you do that. I have offered many times to follow up outstanding debts for you and you say no. Right now I could be calling trying to collect money in for you. You also have all the new bookings I have just done that you can invoice for deposits right now that will pay, if you are that much in debt as you say you are why are you away, you should be chasing up what is owed!!! You could have plenty of cash coming in at the moment and even the new sales I did apart from 2 are all paying deposits pretty much straight away, then another payment in June then September, so you have money staggered through out the year from Custom Homes not just in 12 months time, only a few that pay on publication, rest make payments during the year before print. It is also not my fault that the outstanding $25,000 has not been collected, that is not my role but I do offer.

I am very angry now that you could treat me like this and not even say Merry Xmas to me, thanks for all your work this year and just go away for two weeks and know that I would have no money, that is really awful of you to do, I do not deserve to be treated like this, you haven’t even sent me an apology. If you had of told me earlier we could of worked something out but to just throw me aside and not tell me I won’t be paid this week or even for a few weeks is really bad after all I have done for you and the sales I make. Why send me out to keep selling if you knew you couldn’t pay me, we also have an employment agreement and if I don’t get any money in the new year for the 2 weeks work I have done, the holiday pay I am owed and the commissions I am owed to date then I will contact the Fair Work Ombudsman reluctantly to resolve this.

My job is not to do the accounts, my job was to make sales which I did, I can’t help if you don’t follow up on the invoices, you have money there now to collect, go get it, you say you are getting sued everywhere and won’t have any money till mid Jan and most is gone on bills due last month, well guess what I am also an important bill that is due. I can’t believe you expect an employee to wait over 6 weeks for outstanding monies, such poor form. Almost all the Custom homes sales I did will pay you a deposit now which will more than cover my pay/commissions due and also there was other sales in that last batch that were for Adconnect and Directorys that can be invoiced straight away. The last thing I want is for this to turn nasty or be bickering with you but I am sure when I get calls from clients in the new year you won’t want me telling them about this and why I am no longer working there, you have not done the right thing by me at all.

I have so loved working for you and am so sad it has come to you doing this to me, I know it is not by choice but you have not handled yourself well in regards to me and the running of the business, it is only cos I am emailing you that you have now admitted you can’t pay me otherwise I would still not know and really I am so so flabbergasted that a few days before xmas you would run off and not pay me a dime, very very hurtful. yes I understand that – I have been ripped off for 12 months by various people, no one has ever worked a 40 hour week for me, and I have had to pick up the slack and have done 60 hour weeks. All the prima donna contributors want thousands for crap writing also

I cant pay any commissions and I cant afford 15% on rebookings which just take an email – $1000 a shot for a builder or supplier is too expensive

None of those people have paid the deposit – they have all been billed immediately – they always take weeks to pay

These are small businesses, Custom Homes makes only $200,000 and adconnect less than that

Remember I have also paid $1.3 million dollars for all of this – the Ooh media posters take me 3 days every 2 weeks, and the Ooh media sub lease I had to spend $500,000 on signs to get that job

So far I have not been returned $1 on Ooh media or Custom Homes, when you take the purchase costs into account – which is $1.6 million all up

I can probably keep you if youre willing to work for 3 months on wages only, but otherwise I cant afford it, I cant rack up $30,000 in commissions, I owe the tax man $30,000 and he is suing me, the printers $20,000 and contributors $20,000, and the shops $25,000 on January 1, plus the $10,000 I owe from December 1 gone.

Its just not working I probably have to sell it all to get paid myself

I really have to close for 3 months and do it all myself, cant see any other way out – that or sell everything

Im tired of being abused every week by a different asshole somewhere too, I have flogged myself and have had enough

You also can’t change your employment agreements without consulting your employee first, you asked me to resell Custom Homes, you knew I was selling it, you knew how much I had sold and you never once attempted to renegotiate my agreement prior to me starting to resell it or put anything in writing at anytime to say I won’t be getting 15%, so you can’t change the goalposts whenever it suits you or without advising me of the new terms you want to bring in, I have had no choice in the matter. My agreement also says I will be paid fortnightly my commissions!!!

It is so wrong to just not pay someone the wages/commissions they are owed and to not tell them this until they had to keep emailing you for any answers, let alone to do it to them just before xmas and their annual leave, horrifying. It is also not my problem what you paid for the business, what they owe you, what they make, how you manage them, how you manage other staff, that has nothing to do with me. You employed me under our agreement, if you now can’t afford me then tell me to see what we can figure out or finish me up properly with the money you owe me or a payment plan. Don’t think you can just not pay me and I will hang around and keep working and not even discuss it with me properly.

If you had of discussed these things with me prior I am sure we could of come to some happy arrangement, however I feel you have totally worked me over and not had a thought about how this has affected me, with no apology forthcoming at all.

I am sorry to say this but I now feel I have no choice but to take this through the proper channels to be paid what I am rightfully owed.

Major Crash investigators are asking anyone who saw a white Jeep Wrangler roll over in Mosman Park on Sunday to come forward to help explain how it happened.

Police spokeswoman Naomi Smith said the Jeep Sport Unlimited (pictured) rolled on October 30 about 2.45pm.

Senior Constable Smith said the crash occurred while the 24-year-old male driver was reversing in the car park near the David Jones Pavilion on McCabe Street.

The driver received received serious injuries and two female passengers received minor injuries.

Anyone with information about how the crash happened should call Crime Stoppers on 1800 333 000.
